Thomas Cox, Last will and testament, November 16th , 1845, Boone County , Indiana.

November 16, 1845

I, Thomas Cox, of the State of Indiana, Boone County, at this time in a greatly diseased state of body, but rational state of mind, do hereby make this my last will and testimony, that there be sold personal property sufficient to satisfy all just claims against me, after which I want Mary my wife to have the balance of the property real and personal, to be hers as long as she remains my widow, after which I want it to be given to my bodily heirs, to be their property to be divided equally among them.
It is also my desire that William Moffitt attend to the settlement of my affairs when I am dead, made in the presence of and written by I. M. Boyd, signed Thomas Cox (x his mark)

State of Indiana, Boone County, to wit the above named Oliver Craven makes affirmation that the above is a just and true account of the sale of personal estate of Thomas Cox late of said county, deceased, Affirmed and subscribed to before me this the 30th day of December, 1845, signed David D. Green, justice of the peace.

(note by JCA. I suspect that the Isaac Cox shown above could have been a brother or a cousin to Thomas Cox and must pursue this lead further. A submission to the LDS IGI files by an LDS member shows an Isaac Cox as a son of Stephen Cox and born 1807 in Holly Spring, Orange County, N. Carolina which is a good match for the 1840 N. Carolina census record showing a Thomas Cox with 4 sons and no daughters under 10 years of age as "Thomas Cox of Stephen"

A search of the 1850 census records for District #7, Boone County, Indiana finds an Isaac Cox as next door neighbours of David Moffitt and his wife Rachael (Cox) as follows:

bullet  Research Notes:

Here is what we know about Thomas Cox so far.
born in N. Carolina
married Mary Moffitt in N. Carolina, Randolph County in Sept 1830
He had 4 sons born in N. Carolina before moving to Indiana (William, Hugh, Joab and Hiram)
He was very likely a Quaker by religion.
He had a daughter Hannah in Indiana.
He died in 1845 in Boone County, Indiana

Note:
A search of all 1840 census records in Randolph County N. Carolina turns up four families headed by a Thomas Cox. Only 1 of them is in the Northern Division of Randolph County and that Thomas Cox family has 4 sons under the age of 10 and no daughters yet. I believe that the odds are very much in favour of this census record to be the same Thomas Cox that moves to Boone County, Indiana and dies there in 1845.

1840 North Carolina, Randolph County, census record . Page 99 of the Northern Division, film M704_369. The Northern Division of Randolph County 1840 census is of particular interest as it contains all four of the references to the surname "Coffin" which is mentioned as the bondsman for the marriage of Thomas Cox and Mary Moffit in 1830. (Samuel Coffin)

"Thomas Cox (of Stephen),
males under five: 2,
males five and under ten: 2,
males fifteen and under twenty: 1,
males thirty under fourty: 1,
females: twenty and under thirty: 1
seven persons in total, employed in agriculture"

The number of children under 10 (four) in 1840 and all males is a perfect fit for this family as per the 1850 census of them in Indiana. The appearence of a male between 15 and 20 is not likey to be a son. The age of the mother (20-30) is also appropriate for being Mary (Moffitt) Cox b. 1811. The note on the census records showing "of Stephen" is very fortunate as most census records do not indicate the name of the head of the household's father as this one did. So it appears that Thomas Cox was a son of a Stephen Cox in North Carolina.
